1.2 By making a booking, or by accepting Delivery of the Equipment, the Customer agrees to these terms.

2. Definitions

2.1 “Customer” means the parent or legal guardian, aged 18 or over, of the child who will use the Equipment, who is financially responsible for the Rental and who agrees to these terms.

2.2 “Equipment” means any item rented or sold by Tourin’ Tots, including but not limited to cribs, pack ‘n plays, car seats, strollers, high chairs, beach equipment and toys.

2.3 “Rental” begins when the Customer confirms a reservation, or accepts Delivery of the Equipment, whichever is earlier. It ends when the Equipment has been Collected and Tourin’ Tots has confirmed there is no Damage.

2.4 “Delivery” means Tourin’ Tots delivering the Equipment to the Customer, or to a person acting on the Customer’s behalf. This may include a villa or house host, a hotel concierge or manager, a car rental agent, a security guard, or any other person who grants Tourin’ Tots access in order to deliver.

2.5 “Collection” means Tourin’ Tots collecting the Equipment at the end of the Rental, at the time and place agreed.

2.6 “Damage” means damage, malfunction, loss or theft occurring during the Rental which requires specialist cleaning, repair or replacement. This includes, without limitation, marks from crayons, markers or stickers; chewing gum; vomit, urine or faeces; food; smoke odour; and other substances that are difficult to remove. It also includes Equipment, or parts of Equipment, not returned within 14 days of the end of the Rental. It does not include fair wear and tear arising from normal use, as defined by the manufacturer.

3. Booking and payment

3.1 Bookings should be made through tourintots.com, where they are entered into our scheduling system automatically. If you would prefer to book by telephone or email, we will place the order for you and send you a payment link. Same-day bookings must also be confirmed by telephone.

3.2 Once a booking is made, a confirmation email is sent summarising the Equipment requested, the amount payable, the Delivery and Collection times and places, and other relevant details.

3.3 Payment is due at the time of booking, or before Delivery. Tourin’ Tots may accept payment before Collection if confirmed in writing.

3.4 All prices are in United States dollars unless stated otherwise.

3.5 The minimum Rental period is two days.

4. Delivery and collection

4.1 Delivery and Collection are free of charge anywhere on Grand Cayman.

4.2 The Customer must provide the date, time and location for Delivery and Collection when booking. Tourin’ Tots will use reasonable efforts to deliver and collect at the times specified.

4.3 Where Tourin’ Tots is not delivering directly to the Customer, the Customer is responsible for informing the receiving party, for example a hotel concierge, housekeeping team or property host, of the Delivery and Collection arrangements.

4.4 Tourin’ Tots will set up the Equipment in the location specified by the Customer, or by a person acting on the Customer’s behalf.

4.5 Tourin’ Tots does not install or remove car seats. Installation and removal is the Customer’s responsibility.

4.6 The Equipment must be available for Collection at the agreed time and place, and in the same condition in which it was delivered, apart from fair wear and tear.

5. Using the Equipment

5.1 The Customer must inspect the Equipment on Delivery and tell us before use if anything appears damaged, incomplete or unsuitable.

5.2 The Customer is responsible for confirming that the Equipment is suitable for the age, weight and height of the child who will use it. Information supplied by the Customer at booking is used to help select appropriate Equipment, but the final decision on suitability rests with the Customer.

5.3 The Equipment must be used in accordance with the manufacturer’s instructions, which are supplied with the Equipment or available on request.

5.4 Children using the Equipment must be supervised by a responsible adult at all times.

5.5 If the Equipment develops a fault, or the Customer has any concern about its safety, the Customer must stop using it immediately and contact Tourin’ Tots without delay.

5.6 The Equipment remains the property of Tourin’ Tots at all times. The Customer may not sell, sub-let or lend the Equipment to any other person.

6. Damage, loss and late return

6.1 The Customer is responsible for the care and safekeeping of the Equipment throughout the Rental.

6.2 If the Equipment is Damaged, the Customer must inform Tourin’ Tots as soon as possible by email. The Damaged Equipment will be collected and replacement Equipment delivered, unless the Rental has ended.

6.3 The Customer is responsible for the cost of returning Damaged Equipment to the condition it was in at the start of the Rental, or for replacement with an item of equal value where repair is not reasonably possible.

6.4 If a car seat rented from Tourin’ Tots is involved in a road traffic accident while in the Customer’s possession, the Customer must tell us so we can remove the car seat from our inventory and so we can maintain a complete history for that car seat. No charge is made for reporting this.

8.4 Subject to clause 8.1, Tourin’ Tots is not liable for any indirect or consequential loss, or for loss of enjoyment, loss of opportunity, or costs arising from travel or accommodation arrangements.

8.5 The Customer indemnifies Tourin’ Tots against any claim, loss, damage or cost arising from the Customer’s misuse of the Equipment, use contrary to the manufacturer’s instructions, or breach of these terms.

8.6 The Customer is responsible for ensuring they hold adequate insurance in respect of their use of the Equipment.

10. General

10.1 These terms, together with the booking confirmation, form the entire agreement between the Customer and Tourin’ Tots in respect of the Rental.

10.2 Tourin’ Tots may update these terms from time to time. The terms in force at the date of booking apply to that booking.

10.3 If any provision of these terms is found by a court or other competent authority to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

10.4 No failure or delay by Tourin’ Tots in exercising any right under these terms shall operate as a waiver of that right.

10.5 These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the Cayman Islands. The courts of the Cayman Islands have exclusive jurisdiction.
